Defense Base Act Insurance

Postby Athena » Thu Apr 14, 2011 5:53 pm

Does anyone here know if a short-term OCONUS trip as a Federal contractor always requires DBA insurance? I would guess always for DOD and DOS and sometimes for others.

I moved this into the main forum because I think it can get a better answer there.

The company you work for dosent provide that for you?

Or if you are a contractor [like you own the company] you get 100% of your DBA insurance costs back

This looks like a good guide from the Department of Labor (pdf file):

http://www.dol.gov/owcp/dlhwc/DBAWorkshopJAC2-22-06.pdf

Looks like you should get it, if you're doing work on a contract for the USG. But one of the untold stories is how the insurance carriers have screwed contractors out of their due DBA benefits. Especially Iraqis and Third Country Nationals. I suppose Afghans, too.

Way to make friends - "you fucked up - you trusted us to take care of your family if you got killed by an IED as a 'terp on a mission with us, or by a rocket in your trailer with three other of your homies from India working in our DFAC!"

From the pdf:

The Six Gates to Cover
1. Any defense base acquired from any foreign
government
2. Lands occupied or used by the US for military
purposes outside the continental US
3. Public work in any Territory or possession under a
contract with the US
4. Public work outside the US not covered under (3)
5. Contract outside the US approved and financed by
the US.
6. Welfare or similar services outside the US for troops
authorized by DOD.

The Defense Base Act
1. Is not limited to defense or bases
2. Applies to employees not just US nationals
3. Applies subcontractors at any level or degree of
separation
4. Applies to foreign companies hiring third county
nationals
5. Applies regardless of the employment contract
6. Applies regardless of length of employment
7. Applies to corporate officers
8. Applies to contracts administered by foreign
governments
. Applies to contracts if the prime contractor, the
administrator and employees are all foreign
nationals
10. Cannot be waived by agencies on grounds of cost
11. Cannot be waived if there is no local workers’
compensation act
12. Cannot be waived on grounds of country of origin of
worker
13. Does not include the Longshore Act minimum
compensation rate
14. Applies to injuries occurring within the US
15. Is the employer’s exclusive liability and the
employee’s exclusive remedy
16. Applies to injuries during employment not just on
the job
17. Has constant unanswered questions. These
include
1. Independent contractors
2. Grants v. contracts
3. Supply contracts
4. Religious workers

I would ask this: Have you read the contract?

That is a pointed question you need to ask your employer. Secondly do not be shy about purchasing supplemental insurance to cover areas you want more horsepower for

Thanks all. It's being bought. Glad they weren't sending me to some DP uninsured, believing The G had my back.

That would be like me thinking the Queen gives a stirling-plated shit about how my day will pan out.

Dear Diary,

Today I became curious as to the well being and activities of one of my subjects in Yorkshire. As I was contemplating this I began to have a severe gastric complaint and excused myself immediately to the commode. After much distress a result was produced and my physician and my valet were summoned. Upon inspection my physician declared my stool to be coated with a thick layer of .925 silver. It was most interesting.

Perhaps with more fibre in my diet and more contemplations of my subjects lives I could help both the United Kingdom and my son's fascination with organic gardening but I do think I am perhaps too old to withstand a regime of production such as this.

After the wedding perhaps?

The Queen of England pretended to be Don Johnson for a while. As she is known to do.

Not for a minute did I believe that. I knew someone had to come up with the right insurance, and I was pretty sure it had to be the folks who'd signed the contract. They, however, didn't realize it - being a small shop new to the world of contracting. In another job I had to go through a special travel desk when I got sent anywhere danger pay applied. I figured there was a reason for that, looked into it, and discovered the DBA.

Thanks for the assistance.
