There is a difference between the European Court of Human Rights (ECtHR) which passes judgement on breaches of the European Convention of Human Rights (ECHR) and the EU courts. ECtHR and ECHR are connected to the Council of Europe, which is NOT the same as the EU although the flags of both the Council and the EU are almost exactly identical (for some reason). Russia for example is a member of the Council (and thereby a party to the ECHR), but obviously we would never let them in the EU. Forget the EU, they have nothing to do with this. Complaints to the ECtHR can be only be made after all national remedies have been depleted. If so, it can be taken up in the court if they find that they have juristiction (since only contries are parties to the ECHR, the UN or NATO for example cannot be tried). If the court finds that a breach of one of the articles has been made, it usually makes the country pay up. To a country this is usually fairly cheap and mostly worth it. If they would have deported him first, and then been found guilty of the breach, they would have had to pay him but he would already be under Jordanian juristiction so he would have been screwed anyway.

No one said it was part of the EU, a couple of colonials (Kurt and Lanky) may have hinted at it but it wasn't explicitly said so your didactory tone could have been dialled down a bit in my view. I'm well aware of the nature of the snares that my country has been caught up in. I take the view that anything with Europe in the title is a threat to my liberty. The fact is that they all act like the Eurovision Song Contest and thoroughly enjoy kicking the Brits up the arse.

Don't tell me that it was Churchill's idea either, I'm not interested. He made some big mistakes, as the Poles and not a few dead ANZACs will tell you, and this was one of them; he should have known better. Read Assignment to Catastrophe for proof that he knew the nature of the beast.

Apologies for my tone, it was not my meaning. I just wanted to categorize the chum before I threw it in the water. I agree that the Council of Europe is completely laughable, and that the EU is a mess. The ECtHR flawed as it is though, is really the only way of stepping over national courts judgements that contravenes basic human rights. Fucked up as it may be it's still better than nothing in my view. As for your view of anything "European" I respect your opinion as I respect all hopeless resistance to subversive master plans, but in the case of the EU it's not gonna help.

My bad, I just had a final exam in international law in crisis and conflict covering these questions and pathetically thought I would actually get some interesting viewpoints. Clearly I was fucking wrong.

Yeah, I don't post much, I'm mainly a reader (except when I've got the time) but am on to something if I say that you just accused me of being Penta in disguise? Is that on account of pointing out that the current judicial human rights systems are seriously flawed? In that case you are mistaking an observation for a political opinion. I'm in security politics, I don't have to mean what I say.
