Judge greenlights libel suit against NPR over Seth Rich reports

A federal judge has rejected National Public Radio’s bid to dismiss a Texas investment adviser’s libel suit over news reports about conspiracy theories surrounding the death of a Democratic National Committee staffer during the 2016 campaign.
Judge Amos Mazzant of U.S. District Court for the Eastern District of Texas ruled Wednesday that the $57 million suit brought by Ed Butowsky makes plausible claims that the network may be liable for defamation for a series of online stories about Butowsky’s role in publicizing assertions that the murdered DNC staffer, Seth Rich, may have been involved in leaking Democratic emails.

NPR’s attorneys argued that the reports by NPR media correspondent David Folkenflik accurately described a separate, prior lawsuit filed by Rod Wheeler, a private investigator and former Washington, D.C., homicide detective whom Butowsky hired to explore the Rich case and who wound up suing Fox News and Butowsky for defamation after accusing Fox of fabricating quotations in a story about Rich’s murder.
Fox eventually retracted the online story it published, although Fox News prime-time host Sean Hannity publicly declared that he was not retracting his statements about Rich’s murder, including unproven claims that Rich might have been killed because of some role in leaking Democratic National Committee emails that U.S. officials say Russia hacked into and handed off to WikiLeaks.
Rich's parents also sued Fox News and Butowsky for defamation over their roles in the Fox reports. A federal judge in New York dismissed that case, but the ruling is on appeal.
In his 37-page ruling Wednesday, Mazzant said Butowsky’s suit against NPR, Folkenflik and top NPR editors met the legal standard to proceed.
“Plaintiff has alleged sufficient facts which plausibly show the Reports were not fair, true, and impartial accounts of the Wheeler complaint,” Mazzant wrote. “Additionally, even if the statements are considered a true report of the Wheeler complaint, as Defendants argue, the organization of the comments combined with the speculative commentary imply wrongdoing.”

Most worrisome for NPR may be the judge’s conclusion that Butowsky did not appear to qualify as a public figure as a result of his financial support for Wheeler’s probe and various actions taken to publicize it. If the judge persists in that view, the network could lose the protections that normally shield news outlets from liability when reporting on matters of public concern.
“At this stage of the proceedings, the facts do not show Plaintiff had anything more than a tangential role in the controversy surrounding the Seth Rich investigation,” the judge wrote.
The ruling means the lawsuit will proceed to the discovery process, including demands for documents and depositions from the journalists involved, Butowsky and others. Both sides in the case filed a motion Wednesday to facilitate that fact-gathering.
NPR spokeswoman Isabel Lara downplayed the significance of the judge’s decision and said the network remained confident in the stories.
“This is an early ruling,” Lara said in a statement. “NPR stands behind its reporting and will continue to defend the lawsuit vigorously. NPR is a public service news organization. We are a trusted source of information for millions of Americans and we take this responsibility very seriously, as we did in this coverage.”
An attorney for Butowsky, Ty Clevenger, said he hoped the decision would prompt NPR to resolve the case.

“If NPR and Folkenflik are smart, they will try to settle quickly,” the attorney said.
NPR argued that many of the claims in its reports, like assertions that Fox’s reporting on the Rich murder was “baseless” and “fake news,” amounted to opinion and not the kind of factual claims that can be the basis for a libel suit.
But Mazzant disagreed.
“The statements made by Folkenflik were made as verifiable statements of fact,” the judge wrote. “The statements at issue were not merely expressing a subjective view. Looking at the context of the verifiable facts, nothing shows the statements expressed Folkenflik’s opinion or merely offer Folkenflik’s personal perspective on disputed facts.”
Clevenger said he thinks the ruling “bodes well” for several other libel suits Butowsky is pursuing, including against CNN, Vox and The New York Times, as well as Wheeler and his attorneys.
The cases are all pending before Mazzant, who is an appointee of President Barack Obama. The judge was nominated in 2014 as part of a compromise with Texas’ Republican senators. Mazzant has repeatedly been sought out by conservative litigants seeking to challenge Obama policies.

Seth Rich Murder Update: FBI Claims They Didn’t Investigate but NSA Claims Can’t Disclose Files Due to Matter of National Security

We first reported in late July that Texas businessman Ed Butowsky filed a lawsuit where he outed reporter Ellen Ratner as his source for information on Seth Rich. The DNC operative was murdered in the summer of 2016 in Washington DC. His murder was never solved. According to the lawsuit Seth Rich provided WikiLeaks the DNC emails before the 2016 election, not Russia.

This totally destroys the FBI and Mueller’s claims that Russians hacked the DNC to obtain these emails.
Butowsky claims in his lawsuit:


Ms. Rattner said Mr. Assange told her that Seth Rich and his brother, Aaron, were responsible for releasing the DNC emails to Wikileaks. Ms. Rattner said Mr. Assange wanted the information relayed to Seth’s parents, as it might explain the motive for Seth’s murder.

On November 9 2016 Ellen Ratner admitted publicly that she met with Julian Assange for three hours the Saturday before the 2016 election. According to Ratner, Julian Assange told her the leaks were not from the Russians, they were from an internal source from the Hillary Campaign.

We later reported that Butowsky and his attorney, Ty Clevenger, requested and obtained documents from the FBI related to their case which we were able to analyze.
According to the duo, they obtained the transcript from former FBI Chief of Staff James Rybicki where he states that the Obama White House was the entity that was pushing the Russia conspiracy as early as October 2016 –

Newly released documents from the FBI suggest that the Obama White House pushed intelligence agencies to publicly blame the Russians for email leaks from the Democratic National Committee to Wikileaks.

This afternoon I received an undated (and heavily redacted) transcript of an interview of James Rybicki, former chief of staff to former FBI Director James Comey, that includes this excerpt: “So we understand that at some point in October of 2016, there was, I guess, a desire by the White House to make some kind of statement about Russia’s…” and then the next page is omitted.

The comment is made by an unidentified prosecutor from the U.S. Office of Special Counsel or “OSC,” not to be confused with the office of former Special Counsel Robert Mueller (the OSC is a permanent office that investigates Hatch Act violations, and Mr. Comey was under investigation for trying to influence the 2016 Presidential election).

Roger Stone’s Indictment

Trump friend Roger Stone is facing charges from the Mueller gang that are based on this key question – who provided the DNC the Podesta emails to WikiLeaks?
The corrupt FBI and Mueller team claim the emails were hacked but neither entity inspected the DNC server which was supposedly hacked. They have provided no proof of this.

The DNC instead hired a firm Crowdstrike, with connections to Mueller and former Obama Director of National Intelligence James Clapper, who provided a redacted report to the FBI and Mueller stating the emails were hacked by Russia.
Former NSA whistleblower Bill Binney claims he has evidence the DNC emails were not hacked but copied most likely on to a flashdrive or something similar.

Now This…
When Ty Clevenger requested documents from the FBI related to any investigation into the death of Seth Rich, they replied that they never investigated Seth Rich and they don’t even have any records on him –

But when documents were requested from the NSA, they replied that they won’t release their records regarding Seth Rich because it’s a matter of national security –

USC 552(b)(1) states: This section does not apply to matters that are—

(A) specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy and (B) are in fact properly classified pursuant to such Executive order;
So the FBI never investigated the Seth Rich murder even though the NSA said the case was a matter of national security?

This too does not pass the smell test.

Trump’s lawyer says he’s just pointing to “nagging coincidences,” even though Rich’s family has begged people to stop speculating about their son’s death.

Donald Trump lawyer Rudy Giuliani promoted discredited conspiracy theories about murdered Democratic National Committee staffer Seth Rich on Twitter early Monday morning, further fueling the baseless speculation that has anguished Rich’s grieving family.
Giuliani quote-tweeted a tweet from conspiracy theorist Matt Couch, whose fevered claims about Rich’s 2016 murder provoked a defamation lawsuit from Rich’s brother. In his tweet, Couch pointed out that, while Washington, D.C. police believe that Rich was murdered in a currently unsolved botched robbery attempt, none of his belongings appear to have been taken by his killer.
Speaking rhetorically from Rich’s point of view, Couch pointed to popular conspiracy theorist talking points about Rich’s murder.
“I was Shot multiple times in torso.. I worked for the DNC….” Couch tweeted. “They called it a botched robbery and sue anyone who investigates it..Who am I?”
“I’d like to know,” Giuliani added in his own tweet.

Rich’s July 2016 murder has inspired a number of conspiracy theories claiming that he leaked Democratic emails to WikiLeaks, and then was murdered by Hillary Clinton or the “deep state” in retaliation.
That idea, which isn’t backed up by any evidence, has been embraced by some Trump supporters—including Fox News host Sean Hannity—because it would mean the emails were released by a whistleblower, rather than by Russian government hackers. In reality, Rich’s neighborhood had experienced a series of robberies in the lead-up to his death, which led police to believe it was likely a botched robbery.


In text messages with The Daily Beast, Giuliani insisted his tweet wasn’t meant to promote any conspiracy theories but merely to ask questions about Rich’s murder, which has remained unsolved.
“I didn’t support any conspiracy theory,” Giuliani told The Daily Beast in a text message. “I raised several nagging coincidences.”
“I vaguely remember it and was asking a question about whether it was ever investigated fully,” Giuliani added. “Don’t remember if it was ever solved? Was it.”
After this article was published, Giuliani doubled down on his speculation and accused The Daily Beast of lacking “proper seductive reasoning.”
“Either you haven’t been trained in proper seductive [sic] reasoning or the most truthful explanation is irrelevant,” Giuliani wrote in a text message.

Giuliani added that the media reaction to the conspiracy theorists made him more suspicious about the case.
“Another new area of suspicion beyond a possible murder of convenience is the overreaction you all have to anyone raising any question about this unsolved murder,” Giuliani wrote. “‘Me thinks the Lady Protests too Much?’”
Rich’s family has repeatedly asked conspiracy theorists to stop speculating about their son’s murder, which has drawn in a number of publicity-seeking right-wing media figures. But in text messages to The Daily Beast, Giuliani said “legitimate questions” about Rich’s murder shouldn’t be off-limits because of “some degree of emotional pain.”
“It is tragic for the family but if we stopped all honicide [sic] investigations until solved because it will cause pain then it would leave many unsolved,” Giuliani wrote. “There are legitimate questions here and the more they are suppressed with this media Hillary/oriented censorship the more the conspiracy theorists thrive.”
Giuliani, a former U.S. Attorney, said he wanted to look at the “parties with the greatest motivation.”
“I’ve done a number of very complex investigation [sic] and you must always look at the parties or parties with the greatest motivation and the most to gain or lose,” Giuliani wrote. “Until a murder is conclusively solved that is always a viable hypothesis. Political censorship or even some degree of emotional pain can not suppress trying to solve an open homicide.”
Rich’s family has repeatedly asked conspiracy theorists to stop speculating about their son’s murder, which has drawn in a number of publicity-seeking right-wing media figures.
Couch, who livestreams his conspiracy theory broadcasts to his fans online, is one of the most dedicated promoters of the Rich claims, despite reports that Russian intelligence agents spread the rumor that Rich’s murder was somehow tied to the Democratic email releases.
In 2018, Couch was sued for defamation by Rich’s brother Aaron Rich, over his claims that Seth had helped to steal Democratic emails and received payment from WikiLeaks for the files. Earlier this month, Couch told a federal judge that he couldn’t afford legal defense to continue fighting the case, and said he had removed mentions of Rich from his website.

This wasn’t true, although Trump associates like Jerome Corsi, Roger Stone, and countless others, have argued vehemently for years that it was. And WikiLeaks, and its founder Julian Assange, knew it.
On July 10, 2016, shortly before the DNC emails were released, Seth Rich was shot to death about a block from his home in the Bloomingdale neighborhood of Washington, DC, in what police believe to be a botched robbery attempt.
As made clear multiple times over the last three years by journalists and investigators, even by some of Trump’s closest confidantes, the 44,000 leaked DNC emails made public 12 days after Rich’s murder were stolen by hackers associated with Russian intelligence outfits. And as the Mueller report details, these hacks resulted in DNC emails and documents being shared widely. WikiLeaks, founded by Julian Assange in 2006, published both stolen DNC emails and the results of a later hack of Hillary Clinton campaign chair John Podesta’s emails in 2016.

But Rich’s murder became a focal point for conspiracy theorists, egged on by Assange himself, who, as Mueller’s report details, repeatedly and falsely implied that Rich had been the source of the DNC emails. Assange even told then-Republican Rep. Dana Rohrabacher that he had “physical proof” that the hack was an “inside job.” The implication was that the leaks were from Rich, who was then, according to conspiracy theorists like Kim Dotcom, murdered because of them.

In short, Seth Rich had absolutely nothing to do with how WikiLeaks got leaked DNC and Podesta emails. Yet both WikiLeaks and its founder repeatedly argued the contrary, despite the Rich family’s desperate pleas for them and others pushing the theory to stop.

In a statement provided to Vox by Seth Rich’s brother, Aaron (who is also pursuing lawsuits regarding the conspiracy theory) said of the Mueller report:

“The special counsel has now provided hard facts that demonstrate this conspiracy is false. I hope that the people who pushed, fueled, spread, ran headlines, articles, interviews, talk and opinion shows, or in any way used my family’s tragedy to advance their political agendas—despite our pleas that what they were saying was not based on any facts—will take responsibility for the unimaginable pain they have caused us. We will continue to pursue justice for Seth’s murderers, as well as those who used his murder to advance their personal or political agendas by advancing false conspiracy theories.”
And Brad Bauman, a former spokesperson for the Rich family whose own role in the case became grist for conspiracy theorist websites like Infowars, said in a statement to Vox:

“Assange did untold damage to a grieving family in order to try and hide his work with Russian intelligence to destabilize American democracy. In the process he misled hundreds of thousands of Americans who are just trying to make sense of our country in difficult and complicated times. Yesterday’s report proved he is a monster, not a journalist, and I hope that’s not lost in the ongoing debate around his recent arrest.”

BOMBSHELL: Is the FBI Hiding Records About Seth Rich?

We broke the story that Michael Isikoff of Yahoo News made strong claims about the FBI’s involvement in the Seth Rich Murder Investigation.

In his Conspiracy Land series Isikoff claims that U.S. Attorney Deborah Sines stated the FBI did in fact investigate Seth Rich’s laptop despite their claims they did not.

But wait, there’s more. Isikoff also claims that former Deputy Director of the FBI Andrew McCabe also says he viewed the laptop, because they received a tip that Seth Rich’s Gmail account had possible been hacked by “Russians.”
The following is from attorney Ty Clevenger who’s suing the FBI for information in the Seth Rich case:
For two years, I’ve blogged about allegations that Democratic National Committee staffer Seth Rich — not the Russians — was responsible for providing embarrassing DNC emails to Wikileaks. I think we’re finally getting close to the end zone.
Last week, I provided the U.S. District Court in Brooklyn with clear evidence that FBI officials were hiding records about Mr. Rich, who was murdered in Washington, D.C. in the summer of 2016. Two days after I filed the motion, Judge Lois Bloom ordered the FBI to respond. The FBI filed a response this afternoon, and it only makes the government look worse.
Before I get to that, let me provide a little background. In my original motion filed on October 8, 2019, I included a transcript from Michael Isikoff’s interview of Deborah Sines, the former federal prosecutor assigned to the Rich case. According to Mr. Isikoff and Ms. Hines, the FBI did investigate Mr. Rich’s computer after his death.

That’s huge, because in response to my Freedom of Information Act lawsuit, the FBI has maintained all along that it conducted a “reasonable” search for records about Mr. Rich and it found nothing. The FBI has also maintained that it was never involved in the investigation of Mr. Rich’s death.

The latter part may be technically true, but I didn’t ask for records about a murder investigation. I asked for all records about Seth Rich, which would include all FBI investigations pertaining to Mr. Rich, e.g., records indicating whether he was the source of Democratic National Committee emails published by Wikileaks.

Bank on it: the FBI is hiding records about Seth Rich

Now, back to today’s events. In the response filed this afternoon, the FBI attacked the statements of Mr. Isikoff and Ms. Hines as “unsworn” and “hearsay,” and it insisted that it did not need to conduct any more searches for records about Mr. Rich. Mind you, I’m just asking the FBI to pick up the phone and call its Computer Analysis Response Team (“CART”) and ask whether CART has any records about Seth Rich. The FBI refuses to do that, even though it has twice called the Washington Field Office (“WFO”) to ask whether WFO had any records about Mr. Rich.
According to the FBI, any CART records would have shown up in the index search of the FBI’s Central Records System (“CRS”). As I explained in a September 17, 2019 motion, however, the FBI had already admitted that not everything gets entered in the CRS. And now we’ve got the former prosecutor who was assigned to Seth Rich’s case admitting that the FBI investigated his electronic devices… yet the FBI refuses to search for records in CART, the place where such records would most likely be found. Suspicious, no?
Judge Bloom scheduled a telephone hearing for 11:15 a.m. on Friday, October 15, 2019, to discuss my motion and the FBI’s response. As you can see from that motion, I’ve asked for permission to take testimony from Ms. Sines, the chief of CART, and the head of the FBI’s FOIA response unit. Somebody’s got some ‘splaining to do.
Incidentally, a couple of sources forwarded an October 2, 2019 press release about a former D.C. federal prosecutor who was investigated for leaking information from a D.C. Superior Court grand jury. Any grand jury investigation of Mr. Rich’s murder would have occurred before a Superior Court grand jury, and Ms. Sines made some pretty shocking revelations to Mr. Isikoff. Is she the leaker?

Attorney Ty Clevenger requested documents again from the FBI related to any communications related to the death of Seth Rich –
Clevenger claims that the FBI did not perform its search in good faith after first declaring that they did not have to perform the search. Clevenger also claims that his client, Ed Butowsky, has information that the Seth Rich’s devices were inspected and he wants the results of those investigations –

Clevenger wants the FBI to continue their search and not cover things up because their first review for documents related to Seth Rich was inadequate.

Incidentally, a couple of sources forwarded an October 2, 2019 press release about a former D.C. federal prosecutor who was investigated for leaking information from a D.C. Superior Court grand jury. Any grand jury investigation of Mr. Rich’s murder would have occurred before a Superior Court grand jury, and Ms. Sines made some pretty shocking revelations to Mr. Isikoff. Is she the leaker?

BOMBSHELL: Is the FBI Hiding Records About Seth Rich?

We broke the story that Michael Isikoff of Yahoo News made strong claims about the FBI’s involvement in the Seth Rich Murder Investigation.

In Isikoff’s Conspiracy Land series where he spent hours slandering me, and claiming that I was a liar, he also screwed up.
In his Conspiracy Land series Isikoff claims that U.S. Attorney Deborah Sines stated the FBI did in fact investigate Seth Rich’s laptop despite their claims they did not.

But wait, there’s more. Isikoff also claims that former Deputy Director of the FBI Andrew McCabe also says he viewed the laptop, because they received a tip that Seth Rich’s Gmail account had possible been hacked by “Russians.”
The following is from attorney Ty Clevenger who’s suing the FBI for information in the Seth Rich case:
For two years, I’ve blogged about allegations that Democratic National Committee staffer Seth Rich — not the Russians — was responsible for providing embarrassing DNC emails to Wikileaks. I think we’re finally getting close to the end zone.
Last week, I provided the U.S. District Court in Brooklyn with clear evidence that FBI officials were hiding records about Mr. Rich, who was murdered in Washington, D.C. in the summer of 2016. Two days after I filed the motion, Judge Lois Bloom ordered the FBI to respond. The FBI filed a response this afternoon, and it only makes the government look worse.
Before I get to that, let me provide a little background. In my original motion filed on October 8, 2019, I included a transcript from Michael Isikoff’s interview of Deborah Sines, the former federal prosecutor assigned to the Rich case. According to Mr. Isikoff and Ms. Hines, the FBI did investigate Mr. Rich’s computer after his death.

That’s huge, because in response to my Freedom of Information Act lawsuit, the FBI has maintained all along that it conducted a “reasonable” search for records about Mr. Rich and it found nothing. The FBI has also maintained that it was never involved in the investigation of Mr. Rich’s death.

The latter part may be technically true, but I didn’t ask for records about a murder investigation. I asked for all records about Seth Rich, which would include all FBI investigations pertaining to Mr. Rich, e.g., records indicating whether he was the source of Democratic National Committee emails published by Wikileaks.

The president’s attorney has traveled to some odd places and sought the help of some colorful characters to defend his client. But Chanel Rion might be the strangest of all.

Rudy Giuliani has found a new ally in his globe-trotting attempts to fight President Trump’s impeachment, teaming up with a cable-news reporter and conspiracy-theory political cartoonist who has suggested that Hillary Clinton killed Democratic National Committee staffer Seth Rich and that Democrats eat people.
In his quest to defend Trump and dig up dirt on his political opponents, Giuliani has enlisted a wide variety of characters in both the United States and Europe. Now he’s placing a big bet on Chanel Rion, a One America News host who dabbles in bizarre conspiracy theories.
On Wednesday, The New York Times reported Giuliani traveled to Hungary and Ukraine this week to set up interviews with former Ukrainian prosecutors who have been critical of former Vice President Joe Biden. The interviews are meant for a series on pro-Trump cable channel One America News hosted by Rion, a reporter, anti-feminist children’s book author, and political cartoonist.


Rion’s show, which takes Giuliani and his allies at their word that Trump did nothing wrong by pressuring the Ukrainian government to investigate Biden and his family, has become a key part of Giuliani’s attempt to rally Trump’s base. But Rion herself has a colorful background that includes one prominent retracted story and support for several conspiracy theories.
Rion has been best known on the right since May, when she was hired as a White House correspondent for OAN, the upstart pro-Trump cable channel that frequently clashes with rival Fox News.
In October, Rion claimed that former FBI lawyer Lisa Page had an affair with former FBI Deputy Director Andrew McCabe. Rion’s vaguely sourced report went viral in corners of the right-wing blogosphere that has become obsessed with Page’s sex life and her connection to the investigation into the Trump campaign and Russia. But Rion’s network quietly retracted the entire story later that month.
Rion didn’t respond to a request for comment from The Daily Beast.

Before joining OAN in May, Rion developed some level of notoriety on the internet for her bizarre political cartoons, in a self-published set of online cartoons dubbed “The Left Edge.” In one, Rion promoted the conspiracy theory that Clinton was behind the unsolved murder of DNC staffer Rich, which police have concluded was a botched robbery. In another, she referenced “spirit cooking”—the baseless claim, popular with believers in the Pizzagate conspiracy theory, that top Democratic officials are involved in Satanic cannibalistic sacrifices.

Not all of Rion’s cartoons promote conspiracy theories, but many of them are still strange. In one, former Senate Majority Leader Harry Reid (D-NV), dressed as an alien, comes to Earth to criticize then-FBI Director James Comey. Reid is depicted as arriving in a UFO inexplicably labeled “Planet Zoombo.” In another, she called on “armed citizens to defend America from violent left,” claiming without evidence that Democrats were plotting assassinations.
In one cartoon, Rion portrays the Academy Awards’ Oscar statue as a woman named “Oscareena.”
“He claims his name is Oscareena and he wants the keys to the little girls’ peek-a-boo room,” one character in the cartoon says.
Rion’s website claims that she has “become known as the best political illustrator in the country for constitutional conservative and anti-leftist causes,” but it’s not clear that her “Left Edge” cartoons have circulated much on the broader right. Another website operated by her fiancé claimed that people all over the world are wearing T-shirts and putting up posters of her art. Rion didn’t respond to a request for proof of that claim.

“Rion claims that her family left the United States in disgust after Bill Clinton beat Bob Dole in the 1996 presidential race, setting out to see for themselves ‘what a debauched idea socialism was.’”

After describing a stay in South Korea “a few miles” from the demilitarized zone on the border with North Korea, Rion takes her narrative to France, where she finds herself in a classroom with “presumably communistic” fellow students. Rion’s bio page claims that her family initially lived in a mill but left when “the miller quit.”

“When winter came,” the biography reads, “the miller quit and we moved to an unheated stone maison in the hills of a communist farming village in the mountain region of France where we bought goat cheese and baguettes every day from a monastery on the way home from school and where dad again swore we were never returning to the U.S. Chanel spent her first-grade year not speaking English at school where she heard not a word about politics from her presumably communistic first-grade French classmates.”

Since then, Rion claims to have produced a series of mystery books called Mystery by Design, meant for “traditional girls,” that have been “offered as language trainers in grim and dedicated rote English-learning venues including China and South Korea.” On her website, Rion writes that her books stand “apart from the gender-hostile, Hollywood ‘rip and hate’ spirit of radical feminism.”

A Wonkette investigation of Rion’s claims about her books in 2018 turned up no reference to the books outside Rion’s own website and no evidence anywhere that the books are for sale or actually exist. Rion didn’t respond to a request for comment about her books.

Rion shot to some level of broader fame on the internet in 2018 after her fiancé, then-Missouri Senate candidate Courtland Sykes, cited her cooking him dinner every night at 6 p.m. in a bizarre rant about feminist “she devils.”
“I want to come home to a home-cooked dinner at 6 every night, one that she fixes and one that I expect one day to have daughters learn to fix after they become traditional homemakers and family wives,” Sykes said in a statement.
Sykes, who had been a Missouri resident for less than a year before he launched his bid, struggled to explain his connection to the state. At one point, he told the St. Louis Post-Dispatch that his family had vacationed in the Ozarks, then refused to say exactly where.

Sykes went on to badly lose the primary to future Sen. Josh Hawley (R), coming in eighth place with about 2 percent of the vote.

Deep State DOJ Tells Judicial Watch it Can’t Produce Documents on Imran Awan Due to “Technical Difficulties”

Conservative watchdog group Judicial Watch is not letting the Imran Awan Democrat IT scandal go.
Judicial Watch filed multiple FOIA lawsuits seeking documents related to the Imran Awan Democrat IT scandal and a federal court ordered a hearing for this Friday, December 13 on the Awan brothers!


Imran and his two Pakistani brothers were paid millions of dollars for managing the IT affairs for several Democratic government officials. They were relieved of their duties in February 2017 on suspicion that they accessed specific computer networks without permission, also known as hacking.

Abid, Imran, and Jamal Awan were barred from computer networks at the House of Representatives in February 2017.
In July of 2018, the DOJ agreed NOT to prosecute Imran Awan, but Judicial Watch kept pressing forward with its lawsuits in its pursuit of bringing this criminal cabal to justice.

The Justice Department however is claiming it cannot produce the requested documents due to “technical difficulties.”


JW’s lawsuit also revealed there is a “related sealed criminal matter.”
Judicial Watch’s first request, filed on May 26, 2017, sought:

All records related to any investigations or preliminary investigations involving former congressional IT support staffers Abid Awan, Imran Awan, Jamal Awan, and Hina R. Alvi. As part of this request, searches should of records [sic] should include, but not be limited to, the FBI automated indices, its older manual indices, and its Electronic Surveillance (ELSUR) Data Management System (EDMS), as well as cross-referenced files.

All records of communication sent to or from FBI employees, officials or contractors involving the subjects in bullet item 1.
The timeframe for the requested records is May 2015 to the present.
Judicial Watch’s second request, submitted on July 3, 2018, sought:

All records related to any investigations or preliminary investigations involving former congressional IT support staffers Abid Awan, Imran Awan, Jamal Awan, Hina R. Alvi and Rao Abbas. As part of this request, searches of records should include, but not be limited to, the FBI automated indices, its older manual indices, and its Electronic Surveillance (ELSUR) Data Management System (EDMS), as well as cross-referenced files.

All records of communications, including but not limited to emails (whether on .gov or non-.gov email accounts), text messages, instant chats or messages on the Lync system, sent to or from FBI employees, officials or contractors involving the Awan brothers, Ms. Alvi and Mr. Abbas. Records of communications searched should include but not be limited to those between FBI officials, employees and contractors and officials with the Capitol Police, the Office of the Inspector General of the House, and the Office of the Chief Administrative Officer of the House.

In August 2019, the DOJ told the court that it would begin producing records by November 5, 2019. After producing no records, on November 13, 2019 the agency told Judicial Watch that it was having “technical difficulties,” and in a recent email claimed that “difficulties with the production remain.”

In a joint status report filed on December 5, 2019, Judicial Watch reported to the court that the DOJ claimed in a phone call that it was now unable to produce any records to either of the FOIA requests “because the agency was waiting for some unspecified action by Judge [Tanya S.] Chutkan in some other matter so as to avoid having to produce records in this case.” In that same report the DOJ told the court that Judge Chutkan is “presiding over a related sealed criminal matter” that prohibits the government from releasing the requested FOIA information.

Aaron Rich, the brother of Seth Rich is suing Matt Couch for his reporting on Seth who was murdered in the summer of 2016. Seth worked for the DNC at the time.
Judge Richard J. Leon, is a longtime colleague and Georgetown Law School co-lecturer with John Podesta. He is also linked to Fusion GPS.
Matt Couch is probably going to file a motion to recuse Leon.

In a bizarre twist, Aaron Rich and the defendants JOINTLY asked Judge Leon to help arrange the deposition of Julian Assange in England.
Julian Assange is the main source who can testify how Wikileaks obtained the Podesta emails during the 2016 election.
But in a weird twist, according to our sources, Judge Leon arbitrarily refused the request — even though BOTH PARTIES requested the deposition.
This is unheard of! It is unique in a situation where ALL PARTIES agree that they need the testimony of a particular witness, but the judge blocks it WITHOUT EXPLANATION!

concerns an overlapping question of fact, namely whether former Democratic
National Committee employee Seth Rich played a role in leaking emails from the
DNC to Wikileaks in 2016. I respectfully request your assistance in de-classifying
National Security Agency records that would settle this question once and for all.
As you are probably aware, Mr. Rich was murdered in Washington, D.C.
shortly after the emails were released, and Julian Assange strongly inferred that
Mr. Rich – rather than Russian hackers – was responsible for sending the emails to
Wikileaks. Conversely, Special Counsel Robert Mueller, the FBI, and the
intelligence establishment all have insisted that Mr. Rich played no role in
transferring the emails.
I am reliably informed that the NSA or its partners intercepted at least some
of the communications between Mr. Rich and Wikileaks. Before elaborating on
that, however, I should first note the extent to which the “deep state” has already
tried to cover up information about Mr. Rich. In an October 9, 2018 affidavit
submitted in a Freedom of Information Act lawsuit, FBI section chief David M.
Hardy testified that (1) the FBI did not investigate any matters pertaining to Mr.
Rich, and (2) the FBI was unable to locate any records about Mr. Rich. Both
claims were unequivocally false.
Last September, Judicial Watch inadvertently obtained records about Mr.
Rich by requesting communications between FBI lawyer Lisa Page and
supervisory agent Peter Strzok. The header in the heavily-redacted email string is

something pertaining to Mr. Rich.

redaction codes on the email indicate that there was some sort of investigation
pertaining to Mr. Rich, contrary to Mr. Hardy’s affidavit. Furthermore, the email
string originated in the Washington Field Office, which is exactly where I had
originally asked the FBI to search. The FBI refused to search there and, even
though emails have since surfaced from the Washington Field Office, it still
refuses to search there for records about Mr. Rich.
On March 20, 2020, I deposed former Asst. U.S. Attorney Deborah Sines,
the prosecutor assigned to the Seth Rich murder case. She testified that (1) the FBI
investigated a possible intrusion into Mr. Rich’s electronic accounts; (2) the FBI
examined Mr. Rich’s computer; and (3) the FBI did have records pertaining to Mr.
Rich. Ms. Sines further testified that she met with a prosecutor and an FBI agent
from Mr. Mueller’s team (ergo there should be an FD-302 form from that
interview). Again, this flatly contradicts the FBI’s official narrative that (1) Mr.
Rich was never the subject of an FBI investigation; and (2) the FBI has no records
pertaining to Mr. Rich.
In a recorded telephone conversation with my client, famed journalist
Seymour “Sy” Hersh claimed that he spoke with a high-ranking FBI official who
confirmed the existence of email communications between Mr. Rich and
Wikileaks. My client separately spoke with another federal official who said he
had seen the emails between Mr. Rich and Wikileaks.
Meanwhile, I’m sure you are familiar with the recent evidence that the FBI
framed Lt. Gen. Michael Flynn and perpetrated frauds on the FISA court, all for
the purpose of promoting and perpetuating the “Russia collusion” hoax. Suffice it
to say that high-level officials have gone to extraordinary lengths to keep the hoax
alive, and that extends to the false narrative that Russian agents were responsible
for hacking the DNC. In Mr. Mueller’s report, for example, he claims that Mr.
Rich played no role in the DNC email theft, but the only “evidence” he cites is a
CNN report. Tellingly, Mr. Mueller and his staff made no attempt to interview the
one person who would best know the source of the emails,
i.e.
, Julian Assange.
Now, back to the NSA. Former NSA officials Bill Binney, Ed Loomis, and
Kirk Wiebe are prepared to testify that the DNC emails published by Wikileaks
could not have been obtained via hacking. Markings on the published emails –
including the speeds at which the email files were transmitted – exclude the
possibility of hacking. Instead, someone must have downloaded the files onto a
thumb drive or something similar. Furthermore, the NSA or its Five Eyes partners

in London would have intercepted any communications between Mr. Rich and
Wikileaks.
I have enclosed an October 4, 2018 letter wherein the NSA refused to
produce 32 pages of records about Seth Rich insofar as those records were
classified. I have also enclosed a November 22, 2019 letter wherein the NSA
declined to produce records in response to a subpoena duces tecum. One of my
consulting experts, Larry C. Johnson, was informed that the NSA possesses
additional communications between Mr. Rich and Wikileaks. Mr. Johnson is
retired from the CIA, and he has spoken with an intelligence official who said
there were additional communications.
Section 1.7 of Executive Order 13526 prohibits the use of classification for
purposes of concealing wrongdoing, and I believe the NSA is trying to conceal
wrongdoing that occurred during the Obama Administration. I respectfully request
that you de-classify the NSA’s records about Seth Rich, further directing the NSA
to release the records. Releasing the records would certainly help my client, but it
would do a lot more than that. Disclosure would go a long way toward exposing
the depravity of the “deep state,” and that is long overdue.

The National Security Agency is in possession of at least some communications between murdered DNC staffer Seth Rich and WikiLeaks, according to lawyer Ty Clevenger.
In a letter to Rick Grenell, the acting Director of National Intelligence sent Thursday, Clevenger explained how the FBI lied to him about possessing documents related to Rich while he was seeking FOIA documents about FBI agent Peter Strzok, one of the “Russian collusion” lead operatives.
“I am reliably informed that the NSA or its partners intercepted at least some of the communications between Mr. Rich and Wikileaks. Before elaborating on that, however, I should first note the extent to which the “deep state” has already tried to cover up information about Mr. Rich,” Clevenger wrote.

“In an October 9, 2018 affidavit submitted in a Freedom of Information Act lawsuit, FBI section chief David M. Hardy testified that (1) the FBI did not investigate any matters pertaining to Mr. Rich, and (2) the FBI was unable to locate any records about Mr. Rich. Both claims were unequivocally false.”
Clevenger went on to say that several high-ranking FBI and NSA have seen the correspondence between Rich and WikiLeaks firsthand.
“In a recorded telephone conversation with my client, famed journalist Seymour “Sy” Hersh claimed that he spoke with a high-ranking FBI official who confirmed the existence of email communications between Mr. Rich and Wikileaks. My client separately spoke with another federal official who said he had seen the emails between Mr. Rich and Wikileaks,” he wrote.

This comes as 57 transcripts held up by House Intelligence Committee chairman Adam Schiff (D-Calif.) were finally released last week, one of which revealing that Crowdstrike, the cybersecurity company the DNC tasked with examining its server to determine how internal emails got leaked to the public, never saw concrete evidence proving Russia “exfiltrated” the DNC servers.
In the 80-page transcript from December 2017, Crowdstrike CEO Shawn Henry admitted under oath that he’s seen no “conclusive” evidence proving the Russian government penetrated the DNC server.
Notably, special counsel Robert Mueller, who “investigated” the “Russian collusion” narrative for over two years, made no attempt to interview WikiLeaks founder Julian Assange to determine who leaked the DNC emails to him, and has claimed that Rich played no role in the leaks.

In June 2016, Ellen Nakashima, a Deep State favorite from the Washington Post, released a report that the Democrat National Committee (DNC) had been hacked by Russia. The firm that validated this was Crowdstrike and its President Shawn Henry confirmed the claims. In December 2016, Ms. Nakashima followed up her reporting with the outlandish claim that the CIA had determined that Russia hacked the DNC because they wanted Trump to win the election. Nakashima also reported that the the Intel Community had determined that Russia also sent the emails to WikiLeaks. This position was reinforced by the Mueller gang in their efforts to have President Trump removed from office.

WikiLeaks did release DNC emails related to John Podesta, Hillary Clinton’s Campaign Manager, in the months before the 2016 Presidential election which showed massive corruption combined with an elitist attitude from members of the Hillary Clinton team – all willing to do whatever it took to win the election. The emails were very revealing but the mainstream media chose not to share the damaging and corrupt information because they were all behind Hillary winning the election.

On March 8, 2020 and before on June 16, 2019, we presented arguments against the Mueller gang’s assertion that the DNC was hacked by Russians.

Cyber expert Yaacov Apelbaum posted an incredible report with information basically proving that the DNC was not hacked by the Russians.

Then last Friday, after years of being hidden by corrupt lying Representative Adam Schiff in Congress, a number of testimonies related to the Russia collusion sham were unveiled after Schiff received pressure from Richard Grenell, the Acting Director of National Intelligence (ADNI). One transcript was from Crowdstrike’s Shawn Henry who stated under oath that Crowdstrike had no evidence that Russia even “exfiltrated” the emails from the DNC. The whole ‘Russia stole the DNC emails and sent them to WikiLeaks’ story was a fraud.

This leads us to today. Many people suspected that in 2016 a young man working for the DNC by the name of Seth Rich, copied emails from the DNC and shared them with WikiLeaks. Mr. Rich was murdered in Washington D.C. in July 2016 but his wallet, phone and watch were found on his person when the police arrived at the scene. We reported numerous oddities surrounding his death.

For years the Seth Rich story has been covered up and labeled a conspiracy. However, we reported numerous incidents and activities within the Deep State related to covering up the Seth Rich story. We recently reported that Judicial Watch released documents obtained in a FOIA request. These emails revealed that corrupt cops Peter Strzok and Jonathan Moffa were copied in an email regarding a report from Daily Mail where ex-Brit Craig Murray claimed he traveled to Washington DC and obtained Clinton emails in an exchange in a wooded area near American University.

The Mueller gang never looked into the Seth Rich matter and never interviewed Julian Assange from WikiLeaks to determine who provided him the DNC emails which were reportedly the cause of the Russia collusion sham.
In a prior post related to this subject we detailed the many actions taken over the past few years to determine if Seth Rich was the one who provided emails to WikiLeaks.

Recently, transcripts of a conversation between George Papadopoulos and a confidential informant believed to be Stefan Halper were released by the DOJ. This transcript confirms that Papadopoulos was spied on and recorded, two things Papadopoulos was not told at the time of the case made against him by the Mueller gang.

We know from our previous reporting that a Deep State Anti-Trump former Assistant US Attorney claimed under oath that the FBI did examine Seth Rich’s computer and that she met with an FBI Agent and prosecutor from the Mueller gang. This indicates the meeting should have been recorded in a form 302 but the FBI continues to claim no records related to Seth Rich are available!

We reported in mid-February how Attorney Ty Clevenger, who represents a client who is being sued for his comments about Seth Rich, reported to the courts that despite numerous assurances from the FBI that they had no information related to Seth Rich, emails related to Seth Rich were identified and provided to Judicial Watch. It looked like the FBI was lying to Clevenger all this time.

Attorney Clevenger sent a letter to ADNI Rick Grenell that he should receive by this Monday.
According to Ty, the NSA, knows exactly who sent the records to Wikileaks. So does the FBI. Seth Rich is the last shoe to drop, and the Trump Admin needs to hurry up and drop it
Clevenger goes on to state the most shocking statement related to the Russia collusion sham to date:

In early May (as we reported at the time), Attorney Ty Clevenger wrote to Richard Grenell at the DNI and shared the following:

According to Ty, the NSA, knows exactly who sent the records to Wikileaks. So does the FBI.
Today it is now suspected that the CIA had a more prominent role in the fabrication that Russians hacked the DNC and “fingerprints” were identified in the purported hacking. A non-profit group by the name of ‘The Transparency Project” is requesting data from the CIA related to these actions.

After several years of investigative reporting we now know there is no evidence Russia hacked the DNC and sent the hacked emails to WikiLeaks.
